These terms and conditions apply to the Misfits “Love it or your money back” (the “Promotion”) run by Misfits Health Ltd (“Misfits” or the “Promoter”), a company registered in England & Wales with registration number 09935231 and whose address is LABS Atrium, The Stables, Chalk Farm Road, London, NW1 8AH.
1. The Promotion is open to UK residents who are aged 18 and over.
2. The Promotion only applies to a single purchase of a single-flavour multipack from the Misfits “New & Softer” range of protein bars from the Promoter’s UK website at https://misfits.health/ during the promotional period (15 May 2024 to 1 July 2024).
3. To claim your money back, you must follow the steps below:
4. Claims must be made within 30 days of the original purchase. Any claim attempts made after this date, or for orders that are not dated within the promotional period, will be deemed invalid.
5. Only one claim for a single refund per household is permitted.
6. Participants cannot make claims under someone else’s name or address. Please ensure you use your legal name at the time of claiming. The Promoter reserves the right to disqualify any claimant who uses multiple names or any false names and to require them to return to the Promoter any refund awarded.
7. Each valid claim will receive a refund equal to the amount paid for the relevant item in the original order.
8. For valid claims, refunds will be (i) made to the original payment method from the relevant order, (ii) provided within 5 business days of the completion of the verification process. Payments cannot be reversed once they have been processed. No replacement payments will be granted.
9. If more than the permitted number of claims are received from the same address, all such claims and any associated claims from their household will be disqualified. Bulk claims made from trade, consumer groups, or third parties will not be accepted.
10. Incomplete or illegible claims, or via third parties or syndicates, claims by macros or other automated means, and claims which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is attempting to circumvent this condition by, for example, using identities other than their own or automated means, their claim will be void.
11. Your statutory rights remain unaffected.

The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted, or misdirected claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, traffic congestion, technical malfunction, transmission interruption, communications failure, or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware, or software failures of any kind which may restrict, delay or prevent participation in the promotion.
14. Where a claimant (i) has not completed fully; or (ii) has been found to be in breach of any of the terms and conditions of this promotion, the spirit of the promotion, or any instructions forming part of this promotion’s claim requirements, the Promoter may enforce its right to disqualify that person and require the return or reimbursement to us of any refund even where a refund has already been awarded and/or actually provided to the Claimant or awarded to the Claimant in question.
15. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
17. The Promoter’s decision is final with regard to all promotional matters.
18. The Promoter reserves the right to modify, suspend, or terminate the promotion and/or these terms and conditions at any time without prior notice.
19. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Claim instructions are deemed to form part of the terms and conditions and by participating, all claimants will be deemed to have accepted and be bound by the terms and conditions.
20. English law shall govern these terms and conditions and the courts of England and Wales shall have exclusive jurisdiction unless you live in another part of the UK, in which case your local courts will have jurisdiction.
21. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these terms and conditions, and the remaining clauses shall survive and remain in full force and effect.
